
Can an employee be forced to file a California workers compensation claim?
The company wants an employee with a slight injury to go to the Workers Comp clinic to be looked at and also have a drug test administered. However, this employee has no intention of opening a Workers Comp claim. Can the employer legally force the employee to go to a Workers Comp clinic to be looked at and be administered a drug test?
i don’t think they can be forced to file a claim, but the company will be within their rights to require that the employee, sign a waiver or release stating they will not sue if there is trouble from the injury later on. call your local labor board for some advice.
