My first question did not have enough information……If I cancel my Workers’ Compensation claim, can I then?

If I CANCEL my Worker’s Claim (because of the TOTAL STRESS AND DUBIOUS TREATMENT RECEIVED), can I receive treatment through Medicare for those work related injuries to my head, spine, neck and shoulder? I sincerely hope so.

You would be better off settling the workers’ comp claim for a nominal amount with proper handling of future medical care rather than just dismissing your claim. If you are currently eligible for Medicare and have an ongoing w.c. claim, Medicare already has an interest in your claim. If you just forget your w.c. claim, Medicare will still have a right to deny treatment and care and potentially withhold future benefits. The Medicare review threshold is $25,000, so technically you can resolve an ongoing case for less than that, properly set aside future medical treatment money and not have to submit for Medicare’s review. Anything other than that really has a potential to jeopardize your future Medicare and/or Social Security benefits.

If you are receiving bad medical treatment, get a new treating physician.
