
Worker comp settlement amount?
I am 31 yr old male and fell off a step ladder at work. I landed on some stairs and rolled my toes down to my calf, broke my foot in two places sprained my ankle and stretched my tendon.( workman’s comp ) w.c. started paying me time loss payments of 1100.00 every two weeks. A couple weeks later I started ( PT ) physical therapy a month after PT stared they found out it was broken in two places then placed me in a cast. After the cast I did more PT but it didn’t seem to be helping. So 8 months after the injury I had surgery to try and cure the problem with the pain and stability but no luck. After surgery I did some more PT but it didn’t help either. So here I am a lil over a year later.All I have ever done is construction and tall ladders.The doctor said no more ladders he also mentioned they will offer me a settlement soon because there is nothing more he can do for me. So my question is how much will I get for a settlement ? And what am I gonna do for work ? I live in Oregon!
What you will be entitled to is something called permanent partial disability (PPD). Normally what this means is that your doctor will rate you a percentage that you lost couple with range of motion, strength and sensitivity. In Oregon they have a formula that is provided by the state which will come out with an amount for your permanent partial disability award. You are entitled to this amount.
If you don’t like the award given to you, than you can always request a hearing with the work comp board for more PPD. This is called reconsideration in OR. However the reward is that you could get more money added on to your PPD award, the down side is that you could even get less PPD and than you would owe the money back to the state of OR with an order to pay within 30 days.
As for other settlement it’s up to you and what your doctor does. In Oregon you will be eligible for a vocational rehabilitation evaluation since you will be awarded PPD. If your doctor indicates that you cannot return to usual and customary duties your likely to qualify for VR, which will allow you to train for a different position or job via trade school or community college.
If you don’t want to go to VR than you can always settle this portion out. You can probably get a good $10,000-$20,000 plus your PPD to settle the claim out and go on with life.
