An employee injured at work. The employer is laying off an employee, because argueably the employee has an accident in employees while the employee receives benefits through compensation workers, but also indicates that if the employer terminates the employee for lack of work, the employer must give preference to employee if a vacancy. Employer hired someone else after the employee has applied for employment after released by a doctor, but was never contacted. Would YOU? Find in favor of the employee? Find it in favor of the employer? Why, why not?
If I was a member of the jury, I must listen to both sides, however, it appears the employee has a very good deal. I would probably go in favor of the employee, but that's just me. Hope this helps.
