
fracture nonunion missdiagnosed – Legal Options?
Eight years ago I broke my wrist. When I had the cast removed, they xrayed my wrist and said it had healed fine. It gave me a wrist brace because I was in much pain and discomfort. The pain and discomfort never went away. I was told it was normal. Six months ago, I had an accident on the same wrist was xrayed again and said I did not break. I was referred to my family doctor and paid for the discomfort that I was diagnosed with carpal tunnel. I then went up to 12 weeks of painful physio before they send me back to my doctor because they did not believe it was carpal tunnel. Their doctor reviewed my X-ray source, and said he looked like a fracture non-union From 8 years old, who confirmed a scanner. After 8 years of pain and discomfort and a change of career due to injury, what recourse I'm legal at this point?
You might have a case. But it might be difficult to determine when non-union has occurred (unless you have lots degenerative changes.) Talk to your lawyer. But do not expect a mega-bucks for the award. Most cases (80% or more) without end fault to be found.
